President Donald Trump's former lawyer, Jesse Binall, told Newsmax on Monday that reports the FBI briefed the U.S. Attorney's Office in Delaware corroborated some of the evidence a confidential source told the agency about an alleged bribery scheme involving President Joe Biden and his son Hunter Biden, raising questions about who tried to cover up the evidence.

"One thing we do know is that if it was Donald Trump on the other side, we would have appointed a special counsel from day one, and that special counsel would have spent $25 million a year tracking down Donald Trump and everyone who ever spoke to him," Binal told Newsmax's "John Buckman Now."

“This is a case that requires special counsel from day one.

The FBI's Pittsburgh office confirmed some details of the FD-1023 form eventually released by Sen. Chuck Grassley (R-Iowa), according to a Federalist report Monday.

The form contained information from confidential FBI sources about a $10 million bribery scheme involving the Bidens and the head of the Ukrainian energy company Burisma.

Binal said Monday that the Justice Department would not be able to drop charges against the Bidens after two "courageous whistleblowers" from the IRS came forward.

"Fortunately, Congress has this information," Binal said. "All we have to do is see if lawmakers have the guts to see it through."

Binal said he expected further charges against Trump through special counsel Jack Smith, who he called a "desperate man."

"He will do everything in his power to prevent the American people from electing the next president the way he wants," Mr. Binal. "The president wants to do everything he can to make sure that decisions are made in Washington, D.C., and not somewhere like Florida, where Donald Trump has a fair trial."

And Trump's legal team must now build a strong legal and factual case, Binal said.

He further argued that the allegations against the former president have no basis in law or fact, particularly in relation to the January 6, 2021 protests at the Capitol, adding that "a very strong motion to dismiss will be filed."

"[He] said that people should express their voice peacefully and patriotically," Binal said. "At last check it was not a crime...What the American public will know more clearly is that Jack Smith is pursuing his political agenda through the federal court system."

When Hunter Biden's plea deal goes up in court this week, a judge will have to ask prosecutors tough questions.

“If they agree to plea bargaining, members of Congress must advocate strongly for Hunter Biden to testify before a congressional committee. He has a contract with the prosecution, so he can no longer rely on his Fifth Amendment rights,” Binal said. "The only way we can prosecute him at this point is if he lied to Congress.

“Of course now, [Attorney General] Merrick Garland is not going to prosecute for this.
